“ Similarly, a complainant who is on a leave of
absence could be "participating or trying to participate" in the
recipient's training program or exercise for instance,
these a complainant could continue to be enrolled as a student even even though on depart of absence,
or could intend to re-utilize after a leave of absence and thus is continue to
"attempting to participate" even when on a depart of absence.
A complainant who has graduated may even now be "attempting to participate" in the recipient's education and learning application or exercise
for example, in which the complainant has graduated from a person application but intends to implement to a distinctive plan, or wherever the graduated complainant intends to remain associated with a recipient's alumni applications and functions.
Accordingly, the Department defines a postsecondary institution as an institution of bigger schooling as outlined in § 106.2(l),
an institution of undergraduate larger instruction as described in § 106.2(m), an institution of
expert schooling as described in § 106.2(n), and
an institution of vocational instruction as outlined in Start Printed Page 30139 § 106.2(o).
In this method, the Department defines the subset of educational institutions as described in § 106.2(k) that represent postsecondary institutions
as defined in § 106.30. The remainder of the
entities described as academic institutions in § 106.2(k) represent elementary and secondary schools as explained in the
portion earlier mentioned on the definition of "elementary and secondary college." The
definition of "postsecondary institution" applies only to §§ 106.44 and 106.45 of these remaining restrictions. ”
